Attorney Joel A. Mogren


Attorney Joel A. Mogren has practiced criminal defense since 2002.  During this time he has represented clients at the MunicipalState, and Federal Court levels.  Attorney Mogren has succeeded at both the trial and appellate court levels.

 

Attorney Mogren had federal charges in a drug conspiracy case dismissed against one of his clients.   Another client of Attorney Mogren's at the federal level was facing a recommendation of over 220 months of incarceration by the prosecution because he was determined to be a career offender.  Attorney Mogren convinced the court to sentence his client to the mandatory minimum of 120 months.

 

At the state court level, Attorney Mogren's client was recently acquitted of Recklessly  Endangering Safety By Discharging A Weapon, even though law enforcement recovered a gun, bullets, casings, and had a forensics expert testify that the bullets and casings came from the same gun that police said they saw Attorney Mogren's client drop.  Attorney Mogren challenged the forensics expert's testimony and findings on cross-examination. 

 

In Attorney Mogren's closing argument, he used  a chalkboard to illustrate why there was a reason to doubt the prosecution's case.   Attorney Mogren drew a cat and a mouse in a box.  He explained to the jury that if they saw him place the cat and the mouse in the box, and he covered the top of the box, and a few minutes later the mouse was not there, they could assume beyond a reasonable doubt that the cat had eaten the mouse.  Attorney Mogren then explained that if they again saw him place the cat and the mouse in the box, and he covered the top of the box, and a few minutes later the mouse was not there, but this time the jury noticed a small hole in the corner of the box, small enough for a mouse to escape, then the jury could not conclude beyond a reasonable doubt that the cat had eaten the mouse.  Attorney Mogren then told the jury that if there were holes in the prosecutions case small enough for a mouse to escape, and because of that, they had to find his client not guilty.   The jury listened to Attorney Mogren and found his client not guilty.
